What to do After a License Suspension

 

Following a DUI arrest, you will receive a temporary driver’s license that is valid for 45 days. After you've given your temporary license, you have 10 days to request a hearing with the MVA to challenge your suspension. In these cases, time is absolutely crucial – should you fail to request a hearing, your driving privileges will remain suspended. MVA hearings are trials, decided by administrative law judges. The length of the license suspension varies depending on a number of factors, such as whether you submitted to the breath test, what the result was, whether you refused, and whether this is your first or subsequent offense.

License suspensions may include:

  • First offense: License suspension of up to 9 months
  • Second or subsequent offense: License suspension of up to 2 years
