Baltimore Underage DUI Lawyer

A Baltimore DUI Attorney Can Advocate for You

The legal drinking age all across the country is 21 and no one under this age (except in very few instances) is allowed to consume alcohol. Because of this, many states, Maryland included, have a "zero tolerance" policy when it comes to underage drinkers who are caught behind the wheel. The legal limit for these drivers is much shallower—but the penalties can be just as harsh as those given to older drivers for the same offense.

At The Law Office of Mark G. Scheuerman, LLC, our legal team believes that all drivers should receive every consideration they deserve before the law following a momentary lapse in judgment. This is especially true for young drivers who, with so much still ahead of them, do not need the entanglement of a criminal conviction at such a crucial period of their lives. We know what it takes to assess these cases for the grounds needed for a dismissal or reduction and can ensure your child's case is navigated to the best possible outcome.

Underage DUI Penalties in Maryland

Underage drivers are held to a strict standard when it comes to blood alcohol content. Unlike drivers 21 and older, whose limit is 0.08%, underage drivers of any BAC reading over 0.02% can be arrested for drunk driving. When they are, most of them become exposed to very same penalties older drivers are.

Penalties for underage DUI in Maryland can include:

  • Fines (including court fees)
  • Possible jail time
  • Six-month administrative license suspension
  • Alcohol treatment programs
  • Installation of an ignition interlock device

If the driver is 18 or older, they will be tried as an adult, and the judge is likely to consider penalties that would be applicable to any other accused drunk driver. If the accused is under 18, their case will be handled in juvenile court for consideration. As with other DUI cases, the penalties can worsen for repeat offenses or when there are aggravating factors (such as when a minor is present, or an accident occurs, etc.)

No matter what your child's circumstances may be, our firm can help. Our Baltimore DUI lawyers know what the court looks for in these cases and can ensure that not only will any weakness in the state's case be challenged, but that your child can face the judge with their best foot forward.

  • Great representation

“Mark made a very stressful circumstance a piece of cake. He accurately assessed my situation in our initial consult and what he predicted is exactly what happened ... Case dismissed. He was thorough, patient, knowledge, sincere and honest. While sitting in court i observed the behavior and demeanor of the other lawyers with their clients... No interaction or personal attention. I will recommend Mark anyone he can help. Very pleased”
