Underage DUI Penalties in Maryland

Underage drivers are held to a strict standard when it comes to blood alcohol content. Unlike drivers 21 and older, whose limit is 0.08%, underage drivers of any BAC reading over 0.02% can be arrested for drunk driving. When they are, most of them become exposed to very same penalties older drivers are.

Penalties for underage DUI in Maryland can include:

  • Fines (including court fees)
  • Possible jail time
  • Six-month administrative license suspension
  • Alcohol treatment programs
  • Installation of an ignition interlock device

If the driver is 18 or older, they will be tried as an adult, and the judge is likely to consider penalties that would be applicable to any other accused drunk driver. If the accused is under 18, their case will be handled in juvenile court for consideration. As with other DUI cases, the penalties can worsen for repeat offenses or when there are aggravating factors (such as when a minor is present, or an accident occurs, etc.)
