Maryland DUID Laws

The evaluation conducted by a DRE typically includes the following steps:

  • Eye examination: The DRE will conduct an examination of the driver's eyes, looking for specific signs of drug impairment, such as pupil size, reaction to light, and other eye movements.
  • Divided attention psychophysical tests: The DRE will administer a series of tests similar to field sobriety tests to assess the driver's divided attention capabilities, physical coordination, and cognitive functioning.
  • Vital signs and physical examination: The DRE will measure the driver's blood pressure, body temperature, and pulse rate, as well as conduct a general physical examination to check for signs of drug influence.
  • Blood or urine test: If the DRE determines that drug impairment is likely, they may recommend the driver undergo a blood or urine test to confirm the presence of drugs in their system. This test is typically performed by a medical professional.

Based on the DRE's evaluation, the officer can use the information as evidence to support the arrest and subsequent drug-related DUI charges. The DRE's expertise is particularly valuable in cases involving drug impairment, as they are trained to identify and categorize various types of drugs that may be influencing a driver's abilities.
